Thank you for using Photos. Photos (the "App" or "Photos") is a product that provides you with an immersive experience of browsing photos and videos and allows you to intelligently manage and easily edit your photos and videos.

This Photos Privacy Notice (this "Privacy Notice") explains what personal information we collect from you during your use of Photos, how and why do so, your rights to your personal information, and the security measures we use to protect your personal information.

Before using Photos, please carefully read this Privacy Notice, with special attention to the terms highlighted in bold, to understand our practices regarding personal information protection. If you do not agree to this Privacy Notice, we may not be able to provide you with services related to Photos. By tapping "Agree", you acknowledge that you clearly and fully understand our collection and use of your personal information as described below.


1. How We Collect and Use Your Personal Information

We collect personal information in order to operate more efficiently and provide you with an optimal user experience. We collect personal information about you in three primary ways: (1) directly from you; (2) automatically from your use of Photos; and/or (3) from third parties.

The information we collect depends on the product features you use, the environment in which you interact with us, and the choices you make, including your privacy settings and the products and features you use.

Please note that if the following clauses do not explicitly state that your relevant information will be uploaded to our server, then the information is only stored, collected, and processed locally on your device. This is to clear up all your doubts and ensure that we stay transparent about personal information processing. We will not access, collect, or otherwise process such information, nor will we disclose such information to any third party or use it for any other purpose. This also means that the processing of such information is only performed by you, so it is not subject to this Privacy Notice. If you wish to exercise your rights to such information, or if you wish to modify or delete such information, we will not be able to provide support to you unless you show us how you have processed such information.

Our products and functions include basic and additional functions. By collecting and using your personal information in connection with the basic functions of Photos, we intend to provide you with the basic functions and/or services. You are not obliged to provide the information, but if you do not provide it, in most cases we may not be able to make related services available to you, nor will we be able to respond to or solve the problems you may encounter. You may also not be allowed to use Photos. By collecting and using your personal information in connection with the additional functions, we intend to provide you with more personalized and intelligent Photos services. If you turn on the additional functions, it signifies that you agree to our collection and use of your relevant information. If you do not provide the information, the additional functions may not be available to you. This, however, does not affect your use of the basic functions.

1. The following explains what personal information we collect and use in connection with the basic functions and why we do so:

Local album management

When you manage your albums locally, the Photos app will need to access your storage data, as well as access, read, or analyze the people, things, or text that appear in your photos or videos, so that you can browse, search for, edit, save, or share the photos or videos in your local albums. Information in connection with this function will be stored on your device only. Local album management includes the following on-device features:

Intelligent classification: Intelligently classifies and displays your photos and videos.

Intelligent search: Enables you to search for photos or videos based on keywords, thus helping you manage your albums more efficiently.

Memories: Intelligently creates videos of precious memories based on featured resources.

2. The following explains what personal information we collect and use in connection with the additional functions and why we do so:

(1) Making and restoring photos with AI (only supported by certain devices)

If you wish to make an ID photo or restore your photo using AI, we may request and collect the photo that needs processing. With this information, we will be able to intelligently edit the photo to create the required ID photo or restore the original photo for you. The original photo will be uploaded to the cloud for processing. It will be destroyed immediately after being edited and processed by the cloud server. We will not store your photo or any other personal information on the cloud.

(2) AI-powered color matching (only supported by certain devices)

This function aims to provide you with intelligent photo editing and retouching services. When you use this function for the first time, Photos needs to access your network so that it can download an AI-powered color matcher. When you later use the function to retouch your photos, Photos needs to access your storage data for on-device photo processing.

(3) Displaying location information in photos

When you intend to display the location information in a photo or video, if your device is already connected to the Internet, we may request and collect the longitude and latitude values of the photo or video to derive the physical location information and then display it in your photo or video. The longitude and latitude values we collect will be uploaded to the cloud for calculation purposes. They will be deleted immediately after the cloud server figures out the physical location. We will not store longitude and latitude values or other location information on the cloud.

(4) Text scanner (only supported by certain devices)

If your device is connected to the Internet when you use the Text scanner feature, we may request and collect the image that needs processing for higher text accuracy. If we do so, we will upload your photo to our cloud to perform text recognition. If your device is not connected to the Internet, Photos will perform on-device image processing. In the case that your device is connected to the Internet, the image uploaded to the cloud will be destroyed immediately after the cloud server completes text recognition. We will not store any of your personal information, such as your photos, on the cloud.

(5) Generating location-based memories

To help you generate location-based memories such as memories of your trips, we may need to access your network and collect your device information (DUID, device model, ColorOS version, etc.) to identify your device's location and request background services from Photos. The information we collect will be destroyed immediately after background services are requested. We will not store your device information on the cloud.

(6) Updating features and downloading resources

To provide you with features compatible with your current device and online resource update services, such as downloading algorithmic models and obtaining stickers, music, and other resources, we may need to access your network and collect your device information (DUID, device model, ColorOS version, etc.) and the Photos version and its specific version number to request its background services. The device information already uploaded to the cloud will be destroyed immediately after relevant updates are downloaded. We will not store any of your device information on the cloud.

(7) Shared albums

3. Sharing your personal information with third-party service providers

Some services of the Photos app are provided by third parties. To provide you with such services, we need to provide some of your personal information to these third-party service providers. For example, we may share your personal information with them in the following circumstance:

(1) Photo selection

This service is provided by the Photos app to WeChat. Photos will share with WeChat the people, places, things, and text in your photos or videos, on-device processing techniques (intelligent classification and search techniques), and files in Memories. This is to let you browse files by intelligently classified albums or based on intelligent search suggestions when you intend to share a photo or video via WeChat, thus enabling you to quickly find the required photo or video. The information shared with WeChat will not be uploaded to any server. It is processed on your device only.

4. Requesting permissions from your device

When you use the Photos app, we may request certain app permissions to collect and process your personal information and provide you with specific service functions or services. Specifically, we may request the following permissions.

When a permission is turned on, you may turn it off at any time by following the operation path provided above. After the permission is turned off, the corresponding product feature or function may not work properly.


2. How We Retain Your Personal Information

The personal information we collect will be retained for the minimum period needed to fulfill the purposes for which it is collected as described in this Privacy Notice, unless otherwise specified by applicable laws and regulations. Upon the expiration of the retention period or when your personal information can be deleted, we will delete it or process it using special techniques such as differential privacy to ensure that the information will not relate to you.

When you delete photos and videos from your phone's photo library, they are placed in the Recently Deleted album of the Photos app, where they remain for 30 days and then are permanently deleted. Original copies of the photos restored with AI; ID photos created with AI Original files uploaded to the cloud will be deleted immediately after data processing is completed. You may take the initiative to delete the original files on your mobile phone at any time. When you delete photos or videos from your phone's photo library, they are placed in the Recently Deleted album of the Photos app, where they remain for 30 days and then are permanently deleted. You may go to that album to delete them permanently.
People, places, things, and text in your photos or videos We do not store your image or video files on our server. You may take the initiative to delete them from your mobile phone at any time. When you delete photos and videos from your device's photo library, they are placed in the Recently deleted album of the Photos app, where they remain for 30 days and then are permanently deleted. You may go to that album to delete them permanently.
3. Our Cooperation with Third-Party Software Development Kit (SDK) Providers

The Photos app may contain SDK plugins provided by our authorized partners. When you use relevant functions or services provided by the authorized partners in Photos, the plugins may collect and process your personal information. See the table below for details.

We will carefully review the purpose for which the SDK providers use your personal information, assess their security capabilities, and bind them to our cooperation agreement with the SDK providers. As for your personal information collected by the SDKs as our data processors and shared with the SDK providers by us, its processing (including but not limited to transfer, storage, and usage) is also governed by the privacy terms of the SDKs. To secure your information to the maximum extent, we strongly recommend that you carefully read and fully understand the privacy policies for the third-party SDKs.

4. Third-Party Service Providers and Their Services

Our websites, products, apps, and services may contain links to third-party websites, products, or services. You can choose whether to access or use any website, product, or service provided by a third party.

We have no control over third-party privacy and data protection policies, as such third parties are not bound by this Privacy Notice. Before you submit personal information to third parties, please refer to their privacy policies.

5. Notification and Response to Personal Information Security Events


Please note that although we take reasonable measures to protect your information, no websites, Internet transfers, computer systems, or Wi-Fi connections are 100 percent secure. In the event of any security breach of your personal information, we will, pursuant to applicable laws and regulations, promptly notify you of the particulars and possible impact of such event, the measures taken or to be taken by us, suggestions on how you can prevent and reduce risks, and remedies available to you. We will promptly inform you of the information about such event by email, letter, phone, or push notification. When it is difficult to inform the personal information subjects concerned one by one, we will publish an announcement in a reasonable and effective manner. We will also report the handling of the event in accordance with the requirements of regulatory authorities.

6. How This Privacy Notice Is Updated
We reserve the right to update or revise this Privacy Notice from time to time. Without your express consent, we will not diminish your rights under this Privacy Notice. We will send you update notices through different channels. If you have provided us with your email address, we will notify you of any material changes to this Privacy Notice by email prior to the entry into force of such changes. We will also push a notification to you through your device.
